Terms of Service

1. Platform Purpose

Kinsi provides a technology platform that enables:

• Creators to publish digital content, offer memberships, receive financial support, and sell access to content or goods
• Supporters/Users to subscribe to, purchase, or financially support Creators

Kinsi does not own Creator content and is not a party to agreements between Creators and their supporters.

2. Eligibility

You may use the Platform only if:

• You are at least 18 years old
• You can legally enter into binding agreements
• Your use does not violate any laws in your jurisdiction

We may refuse or terminate access at our discretion.

3. Accounts

You must provide accurate information and keep your credentials secure.

You are responsible for all activity under your account.

We may suspend or terminate accounts involved in fraud, abuse, or policy violations.

4. Creator Content & Responsibilities

Creators are solely responsible for:

• The legality of their content
• Compliance with copyright and intellectual property laws
• Taxes, reporting, and regulatory compliance
• Delivering any promised access, benefits, or goods

Kinsi does not pre-approve Creator content but may remove content that violates these Terms or applicable laws.

Prohibited Content Includes:

• Illegal or infringing material
• Exploitation of minors
• Violent extremism or terrorism support
• Fraudulent schemes
• Sale of illegal goods/services
• Non-consensual sexual content
• Malware or harmful code

5. Payments & Fees

• Payments are processed by third-party payment providers
• Kinsi may charge platform service fees
• All fees are disclosed in the Creator dashboard or fee schedule
• Refund policies are set by Creators unless required by law
• Chargebacks may be deducted from Creator balances

Kinsi may act as a commercial agent for the collection of payments on behalf of Creators.

Kinsi is not responsible for failed payments caused by banks or providers.

6. Donations & Subscriptions

Payments to Creators may be:

• One-time contributions
• Recurring subscriptions
• Purchases of digital content
• Purchases of goods

Unless required by law, payments are non-refundable once access is granted.

7. Platform Role Disclaimer

Kinsi:

• Does not create or control Creator content
• Does not guarantee Creator performance
• Is not liable for disputes between Users and Creators
• Provides only the technical and payment facilitation infrastructure

8. Intellectual Property

All Platform software, branding, and systems belong to Kinsi.

You may not reverse engineer, copy, or resell any part of the Platform.

Creators retain ownership of their content but grant Kinsi a worldwide license to host, display, and distribute it for Platform operation.

9. Termination

We may suspend or terminate accounts if:

• Laws are violated
• Fraud or abuse occurs
• Content policies are breached
• Payment risks arise

Users may stop using the Platform at any time.

10. Disclaimers

The Platform is provided "as is" without warranties.

We do not guarantee uninterrupted service.

11. Limitation of Liability

To the maximum extent permitted by law, Kinsi's liability is limited to the total fees paid to Kinsi in the previous 3 months.

We are not liable for indirect or consequential damages.

12. Governing Law

These Terms are governed by the laws of Hong Kong.

Disputes shall be resolved in the courts of Hong Kong.
